1. Introduction

This Privacy Policy explains how Anchor Up Worldwide LLC (“AnchorUp,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you use the AnchorUp mobile application (the “App”) and our related websites and services (together, the “Services”). AnchorUp is a social discovery service for boaters. It lets you create a profile, discover other boaters and marine businesses near you on a map (“Radar”), express interest in other users, match, exchange messages, and share photo and video posts (“Moments”). By using the Services, you acknowledge that you have read this Privacy Policy. If you do not agree with it, please do not use the Services. Age restriction: The Services are intended solely for adults aged 18 and over. See Section 10.

2. Information We Collect

Information you provide directly includes account and identity information: email address, phone number, date of birth, full name, and display name. We collect profile information such as gender, account type, stated intent, biography, interests, profile photos, additional photos and videos, social handles, and search and discovery preferences including maximum distance. Business accounts may provide a business name, description, category, address and coordinates, published contact details, and business photos and videos. Content you create includes Moments, chat messages and their read or delivery status, reports, support requests, and other correspondence. Interaction data includes profiles you view, express interest in or skip, matches, and users you block or unblock. We collect precise or approximate location with your permission to provide nearby discovery, Radar results, and approximate position sharing. You may turn it off at any time, although discovery and map features will be limited. We also collect device identifiers, push notification tokens, device and app information, language, time zone, notification preferences, usage events, IP-address server logs, crash diagnostics, and on-device session and preference data. We receive confirmation from verification providers and delivery status from Apple and Google. We do not intentionally collect government identification numbers, payment card numbers, precise health information, biometric identifiers, or your contact list.

3. How We Use Personal Information

We use personal information to provide the Services, create and maintain accounts, build profiles, run discovery and Radar map search, calculate distance, form matches, and deliver chat messages. We authenticate users by verifying email or phone numbers, issuing session tokens, and keeping users signed in. We send notifications according to your settings, communicate about service and transactional matters, and send marketing or product emails only where you have opted in. We review reports, enforce our Terms and Conditions, prevent fraud, spam, harassment, and impersonation, honor blocks, and confirm users meet the 18+ age requirement. We also use information to improve the Services, diagnose crashes and errors, develop new features, and comply with legal obligations. We do not use personal information to train third-party generative AI models or for automated decisions with legal or similarly significant effects.

4. How We Disclose Personal Information

Other discoverable AnchorUp users can see your profile details, gallery media, approximate location and distance unless location sharing is disabled, Moments, and messages you send to them. Published business profiles and contact details are visible within the App. Do not post information you would not want to be public. We share information with contracted service providers, including AWS for hosting, databases, media storage and delivery; Google Firebase and Apple for notifications, analytics, and crash reporting; Apple Maps or Google Maps for maps and geocoding; Amazon SES and Google Workspace for email; Twilio for SMS verification; and Expo, Apple App Store, and Google Play for app distribution and updates. We may disclose information to comply with law, enforce our Terms, investigate prohibited conduct, protect people or property, or complete a merger, financing, reorganization, or sale of assets. We also disclose information when you direct us to do so, such as when using a sharing function.

5. We Do Not Sell Your Personal Information

We do not sell personal information for money, and we do not share personal information for cross-context behavioral advertising, as those terms are defined under the California Consumer Privacy Act and comparable U.S. state laws. We have not done so in the preceding 12 months. We do not knowingly sell or share the personal information of anyone under 16.

6. Data Retention

We retain personal information for as long as your account is active and as needed for the purposes described in this Policy. Account and profile data are removed or de-identified within 30 days after account deletion. Profile media and Moments are deleted with your account, subject to short-lived cache and backup expiry of up to 30 days. Chat messages are retained while a conversation exists; on account deletion, conversations are removed from the other participant’s view within 30 days. Safety and moderation records may be kept up to 24 months after account deletion. Server and security logs are retained for 90 days, and analytics events follow provider defaults, up to 14 months. Limited information may be retained longer where required by law or to resolve a dispute.

7. Your Choices

In the App, you can edit or remove profile content; manage location sharing, push notifications, and marketing email preferences; block and report users; and permanently delete your account through Settings. You can limit analytics collection through your device’s advertising and tracking controls, including by turning off Allow Apps to Request to Track on iOS or resetting or opting out of your advertising ID on Android.

8. U.S. State Privacy Rights

Depending on where you live, you may have rights to know or access your personal information, delete or correct it, receive a portable copy, opt out of sale, sharing, or certain profiling, limit certain uses of sensitive information, and receive equal treatment for exercising your rights. We do not engage in sale, sharing for cross-context behavioral advertising, or profiling with legal or similarly significant effects. In the last 12 months, we have collected identifiers; customer-record information; protected characteristics such as age and gender; commercial information; internet or network activity; geolocation data; photos and videos; preference inferences; and sensitive personal information including precise geolocation and sensitive information you voluntarily provide. To submit a privacy rights request, email privacy@anchor-up.app with the subject line “Privacy Rights Request,” or use the in-app deletion control. We verify requests and generally respond within 45 days, subject to permitted extensions. Authorized agents may submit requests with signed authorization. If we decline a request and you have an appeal right, reply to our decision or email privacy@anchor-up.app with “Appeal” in the subject line. California residents may request information about direct marketing disclosures; we do not make those disclosures.

9. Users in the European Economic Area, United Kingdom, and Switzerland

The Services are offered only in the United States. We do not market or make the App available in the European Economic Area, the United Kingdom, or Switzerland, and do not intend to offer Services to people located there. If you access the Services from one of those regions, Anchor Up Worldwide LLC, 6050 NW 102nd Ave, Unit 308, Doral, FL 33178 is the controller. We rely on contract performance, consent, legitimate interests, and legal obligation as appropriate. You may have rights of access, rectification, erasure, restriction, portability, objection, withdrawal of consent, and complaint. Personal information is transferred to and stored in the United States; where required, we rely on appropriate contractual safeguards and supplementary technical and organizational measures.

10. Children’s Privacy

The Services are for adults 18 years of age and older. We do not knowingly collect personal information from anyone under 18. If we learn that a user is under 18, we will terminate the account and delete associated personal information. If you believe a minor is using AnchorUp, contact safety@anchor-up.app immediately.

11. Security

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, encryption at rest for stored data and media, token-based authentication, access controls, and logging and monitoring. No system is perfectly secure. You are responsible for keeping your email account, phone number, and device secure because they are used to authenticate you. If you believe your account has been compromised, contact security@anchor-up.app.

12. Third-Party Links and Services

The App may contain links to third-party websites and services, including social media profiles and business websites that users publish. We do not control those services and are not responsible for their privacy practices. Review their policies before providing information.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will change the “Last updated” date above and, if changes are material, provide additional notice through the App or by email before they take effect. Continuing to use the Services after an update means you acknowledge the revised Policy.
