1. Agreement to These Terms
These Terms and Conditions are a binding agreement between you and Anchor Up Worldwide LLC, a Florida limited liability company, governing your use of the AnchorUp mobile application, websites, and related services. By creating an account or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. Section 17 contains a binding arbitration provision and class action waiver that affects how disputes are resolved.
2. Eligibility
You must be at least 18 years old, have legal capacity to enter a contract, be legally permitted to use the Services, not be subject to applicable sanctions or restricted-party lists, not have a disqualifying conviction or sex-offender registration, and not have had an AnchorUp account terminated for violating these Terms. We may refuse, suspend, or terminate accounts where these requirements are not met.
3. What AnchorUp Is
AnchorUp is a social discovery platform for boaters and marine businesses. It supports personal or business profiles, discovery through Radar, mutual matches, messages, Moments, and blocking and reporting. AnchorUp is a venue for introductions, not a matchmaking, chartering, brokerage, travel, escort, dating, employment, or marine-service provider. We do not participate in user interactions online, on the water, or in person.
4. Your Account
You must provide accurate, current registration information and maintain control of your email, phone number, and device. You may maintain only one personal account and may not sell, transfer, share, or create an account for someone else. Business-account users must be authorized to act for the business and are responsible for the accuracy, legality, licensing, permits, insurance, and compliance of all business information and services. You may permanently delete your account at any time in Settings; certain records are retained as described in our Privacy Policy.
5. License to Use the Services — Subject to these Terms, AnchorUp grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on a device you own or control for permitted personal use. You may not copy, modify, reverse engineer, decompile, create derivative works, rent, lease, sell, sublicense, transfer, or remove proprietary notices from the Services.
6. Your Content — You retain ownership of content you submit. You grant AnchorUp a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, publish, display, and distribute that content solely to operate, secure, and improve the Services. This license ends when content or your account is deleted, subject to limited backups, chats, safety, moderation, and legal retention. We will not use Your Content in external marketing without your separate express permission. You must have all rights and consents necessary to post content, and should not post information you would not want to become public.
7. Rules of Conduct — Do not misrepresent yourself, impersonate others, harass, exploit, threaten, defame, discriminate, post explicit content, share private information without consent, bypass a block, send spam or solicit money, promote prohibited services, introduce malware, scrape or automate access, circumvent safeguards, falsify location, submit abusive reports, break the law, or use the App while operating a vessel in a way that impairs safe navigation. We may remove content, limit visibility, restrict features, suspend, or terminate accounts for violations.
8. Safety — Please Read This Section — We do not conduct criminal background checks or identity verification. You are solely responsible for interactions with other users: exercise good judgment, never send money or sensitive information, meet in public locations, share a float plan, ensure a vessel is safe and lawfully operated, use appropriate safety equipment, and leave any situation that feels unsafe. Boating carries inherent risk of serious injury and death. In an emergency call 911 or hail the U.S. Coast Guard on VHF Channel 16. Report conduct to safety@anchor-up.app.
9. Location Features — Discovery and Radar rely on device location. By enabling location permission, you consent to collection and processing of your location and display of your approximate location and distance to discoverable users. You can disable sharing or revoke permission, but discovery may be limited. Distances, map positions, and place information are approximate, for convenience only, and not for navigation; always use proper charts and approved navigation and safety equipment.
10. Third-Party Content and Services — Profiles, Moments, listings, messages, and user-posted links are third-party content. AnchorUp does not endorse, verify, or assume responsibility for it. Transactions or engagements with other users or businesses are solely between you and that party. The Services also incorporate third-party mapping, notification, analytics, and hosting providers, whose terms may apply.
11. Fees — The Services are currently free. If paid features or subscriptions are introduced, we will show the price, billing period, and renewal terms before purchase. App Store and Google Play purchases are processed by those platforms and subject to their policies. You remain responsible for device, data, and mobile-network charges.
12. Intellectual Property — The Services, including the AnchorUp name and logo, software, design, text, graphics, and all materials other than user content, are owned by AnchorUp or its licensors. These Terms grant no rights in our trademarks or branding. 13. Suspension and Termination — You may stop using the Services or delete your account at any time. We may suspend or terminate access with or without notice if we believe you violated these Terms or the law, created risk, have been inactive for an extended period, or if we discontinue the Services. On termination, your license ends immediately and we handle your data as described in the Privacy Policy.
14. Disclaimers — THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANCHORUP DISCLAIMS ALL EXPRESS, IMPLIED, STATUTORY, AND OTHER WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AND NON-INFRINGEMENT. We do not guarantee uninterrupted, secure, timely, error-free, accurate, reliable, complete, safe, licensed, insured, or lawful Services, users, businesses, content, matches, messages, location data, distances, or map information.
15. Release — To the maximum extent permitted by law, you release AnchorUp and its officers, directors, employees, and agents from claims, losses, damages, or liabilities arising from interactions or disputes with other users or businesses found through the Services, including injury, death, property damage, financial loss, or emotional distress. California residents waive California Civil Code § 1542 to the extent permitted by law.
16. Limitation of Liability — TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANCHORUP AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT OR ONE HUNDRED U.S. DOLLARS.
17. Dispute Resolution — Arbitration and Class Action Waiver — Before arbitration, send a written notice to legal@anchor-up.app and attempt informal resolution for 60 days. Unresolved disputes are subject to binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except qualifying small-claims, intellectual-property, and government-agency matters. Arbitration or eligible court proceedings are individual only: you and AnchorUp waive jury trials and class, collective, consolidated, and representative actions. You may opt out by written notice to legal@anchor-up.app within 30 days of first accepting these Terms.
18. Indemnification — You agree to indemnify, defend, and hold harmless AnchorUp and its affiliates, officers, directors, employees, and agents against claims, damages, losses, liabilities, and expenses arising from your use of the Services, Your Content, breach of these Terms or law, interactions with other users or businesses, or activities undertaken with a person met through the Services.
19. Governing Law and Venue — These Terms and disputes not subject to arbitration are governed by Florida law, excluding its conflict-of-laws rules and the U.N. Convention on Contracts for the International Sale of Goods. For disputes not subject to arbitration, you and AnchorUp consent to the exclusive jurisdiction and venue of the state and federal courts in Miami-Dade County, Florida.
20. Apple App Store — Additional Terms — These Terms are between you and AnchorUp, not Apple. Apple is not responsible for the App, content, maintenance, support, or related claims. Apple and its subsidiaries are third-party beneficiaries and may enforce these Terms. Google Play users are also subject to Google Play Terms of Service, and Google is not a party to these Terms.
21. Changes to These Terms — We may modify these Terms and will update the Last updated date. For material changes, we will provide notice in the App or by email at least 14 days before they take effect. Continued use after changes take effect means you accept the revised Terms; if you do not agree, stop using the Services and delete your account.
22. General — These Terms and the Privacy Policy are the complete agreement between you and AnchorUp. If any provision is unenforceable, it will be modified or severed to the minimum extent necessary. Failure to enforce a provision is not a waiver. You may not assign these Terms; AnchorUp may assign them to an affiliate or in connection with a merger, acquisition, or asset sale. No partnership, joint venture, employment, or agency relationship is created.
